Privacy Policy

We are committed to respecting your privacy. Our Privacy Policy sets out how we collect, use, hold and disclose your personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth)(Privacy Act).

In this Privacy Policy:

  “AML/CTF Act” means the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

  “Client” means a client who has entered into a costs agreement with us to receive our Services;

  “Services” means the provision of our legal services to Clients;

  “us” “we” or “our” means Corptech Legal Pty Ltd (ABN 65 672 213 393) of 10-20 Gwynne St, Cremorne VIC 3121;     and

  “you” refers to any individual about whom we collect personal information.

We may change our Privacy Policy from time to time by publishing changes to it on this website. We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.

1. About us

We provide the Services to our Clients.

2. What personal Information do we collect?

Personal information includes information or an opinion about an identified individual or an individual who can be reasonably identified from the information or opinion. We may collect the following types of personal information:

(a) full name;

(b) residential and business address;

(c) email address;

(d) mobile phone number and other contact details;

(e) professional details (such as your job title and details of the business you represent);

(f) information about your employer or an organisation who you represent;

(g) date of birth;

(h) any information to support the verification of a person’s identity (including government-issued identity document    details, images of identity documents, facial images, liveness information, video recordings, biometric information and  verification metadata);

(i) information necessary to perform our Services and respond to your enquiries;

(j) qualifications, work history and background check information where you apply for a job position with us; and/or

(k) any additional information relating to you that you provide directly to us.

3. How do we collect personal information

(a) We may collect the above types of personal information either directly from you or from third parties when:

(i) you, or the person that you work for, engages our Services;

(ii) you correspond with our employees;

(iii) we search company registers, public records or social media platforms (such as court records, regulatory filings, land registries and LinkedIn);

(iv) our third-party verification service providers verify identity information, assess whether a person matches an        identity document, conduct liveness or fraud checks, and provide verification outcomes;

(v) you have business dealings with us (whether as one of our suppliers, or as a regulator we deal with, or in the context of a transaction);

(vi) in the course of conducting a matter for a Client, including regulatory investigations, litigation proceedings or due diligence, where you are related to the matter in some capacity;

(vii) you, or the person you represent, is a counterparty, or provides services to a counterparty, of our Client; and

(viii) you otherwise provide your personal information to us, such as where you supply your business card to us.

(b) When you apply for a job or position with us we may collect personal information directly from you and from any  recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision regarding whether to make you an offer of employment or engage you under a contract.

(c) If you do not provide us with your personal information, we may not be able to:

(i) provide you (or the entity that you act on behalf of) with our Services;

(ii) communicate with you;

(iii) respond to your enquiries; and/or

(iv) progress your job application.

4. Employee record exemption

In accordance with the Privacy Act, this Privacy Policy does not apply to our acts and practices directly related to:

(a) a current or former employment relationship between us and an employee; and

(b) an ‘employee record’ (as defined by the Privacy Act) held by us relating to the employee,

(Employee Record Exemption).

Personal information which does not fall within the Employee Record Exemption will be dealt with by us in the same way as any other personal information pursuant to the Privacy Act and this Privacy Policy.

5. Why do we collect, hold, use and disclose personal information?

We may collect, hold, use and disclose your personal information for the following purposes:

(a) to enter into, and perform, contracts with Clients and suppliers;

(b) to provide the Services to Clients;

(c) to communicate with Clients and prospective Clients;

(d) to establish and verify your identity before providing Services to you or the person you are acting on behalf of;

(e) to comply with our obligations under the AML/CTF Act including:

(i) establishing and verifying your identity before providing certain services to you or the person you are acting on behalf of;

(ii) assessing and managing potential money laundering, terrorism financing, proliferation financing risks or related compliance risks associated with the provision of our Services;

(iii) making reports required by law under the AML/CTF Act; and

(iv) meeting record keeping obligations under the AML/CTF Act.

(f) to notify Clients of new or changed Services offered;

(g) to send legal or other updates relevant to us or you and to market our products and services to you;

(h) for our billing, payments and debt recovery purposes; 

(i) to comply with our legal or regulatory obligations;

(j) to resolve any complaints or disputes and to enforce our agreements with third parties;

(k) to conduct our business; and

(l) to consider your employment application.

6. To whom do we disclose your personal information?

We may disclose your personal information for the purposes described in this Privacy Policy to:

 

(a) third party suppliers, contractors, subcontractors and service providers so that they may perform services for us or on our behalf including, but not limited to:

(i) third party data storage providers;

(ii) IT and other software and systems providers; and

(iii) third-parties service providers to assist with our obligations under the AML/CTF Act (including identity verification and storage);

(b) our professional advisers and agents;

(c) payment systems operators, billing operators or debt recovery agents;

(d) anyone to whom our assets or businesses (or any part of them) are transferred;

(e) specific third parties authorised by you to receive information held by us; and

(f) third parties required, authorised or permitted by law (including government agencies, regulatory bodies and law enforcement agencies). Such laws may include the Privacy Act, the AML/CTF Act and the rules under the AML/CTF Act. Disclose may include disclosure to the Australian Transaction Reports and Analysis Centre (AUSTRAC) and other regulators. Certain disclosures and restrictions on disclosure may apply under AML/CTF Act’s secrecy and tipping off provisions. In these circumstances, we are prohibited from notifying you of disclosures to AUSTRAC and may be prohibited from notifying you of disclosures to other government agencies or authorities.

7. Disclosure of personal information outside Australia

We may disclose your personal information to our third-party suppliers, contractors, subcontractors and service providers who are located outside the borders of Australia for the purposes outlined in this Privacy Policy. Such third-party recipients may be located in the United States of America and Europe.

8. Using our website, links, integrations and cookies

 

(a) While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.

(b) We may use 'cookies' or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your computer, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable cookies through your internet browser, but our websites may not work as intended for you if you do so.

(c) Our website may contain links and integrations to websites or services operated by third parties. Those links and integrations are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we are not responsible for the privacy practices of any linked or integrated websites or services, and we have no control over, or rights in, those linked or integrated websites or services. The privacy policies that apply to those other websites or services may differ substantially from our Privacy Policy, so we encourage individuals to read them before using those websites or services.

9. How do we hold your personal information?

We store most information about you in computer systems and digital databases operated by either us or our external service providers. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure. We implement and maintain technical and organisational measures to protect your personal information. However, we cannot guarantee the security of your personal information.

We take reasonable steps to destroy or de-identify personal information that is no longer needed for the purpose for which it was collected or as required by law.

10. Do we use your personal information for marketing?

We may use your personal information to offer you products and services we believe may interest you, but we will not do so if you tell us not to. These offers may take the form of emails or other forms of communication.

Where you receive electronic marketing communications from us, you may opt out of receiving further marketing communications by following the opt-out instructions provided in the communication or by contacting us using the information at paragraph 13 below.

11. Accessing or correcting your personal information

(a) You can access the personal information we hold about you by contacting us using the information at paragraph 13 below. You will not be charged for making a request to access your personal information, but you may be charged for the reasonable time and expense incurred in compiling information in response to your request. We may also need to verify your identity when you request your personal information.

(b) Sometimes, we may not be able to provide you with access to all of your personal information and, where this is the case, we will tell you why.

(c) If you think that any personal information we hold about you is inaccurate, please contact us and we will take reasonable steps to ensure that it is corrected.

12. Making a complaint

If you think we have breached the Privacy Act, or you wish to make a complaint about the way we have handled your personal information, you can contact us using the information at paragraph 13 below. Please include your name, email address and telephone number and clearly describe your complaint. We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time. If you remain unsatisfied with the way in which we have handled a privacy issue, you may approach an independent adviser or contact the Office of the Australian Information Commissioner (OAIC)(www.oaic.gov.au) for guidance on alternative courses of action that may be available.
